1. Introduction

Welcome to Five Riyal Trading W.L.L.

These Terms and Conditions govern your access to and use of the Five Riyal website, online store and related services, features, content and tools collectively referred to as the “Services”.

The Services are operated by:

In these Terms, “Five Riyal”, “we”, “us” and “our” refer to Five Riyal Trading W.L.L. “You”, “your”, “customer” and “user” refer to the person accessing the Services or placing an order.

Our online store is hosted using the Shopify e-commerce platform. Shopify provides the technical platform that enables us to operate the online store. However, all purchases made through the Five Riyal website are made directly between the customer and Five Riyal.

By accessing the Services, creating an account or placing an order, you confirm that you have read and agreed to these Terms and the policies referred to in them.

If you do not agree to these Terms, you should not place an order or continue using the Services.

Nothing in these Terms excludes, restricts or limits any mandatory right or remedy available to consumers under the applicable laws of the State of Qatar.

Where there is a conflict between these Terms and a mandatory provision of Qatari law, the applicable law shall prevail.

3. Legal Capacity and Use by Minors

You may place an order only if you have the legal capacity to enter into a binding transaction under applicable law.

A minor may browse or use the Services only under the supervision and with the approval of a parent or legal guardian.

Where an order is placed by or on behalf of a minor, the parent or legal guardian is responsible for supervising the transaction and ensuring the accuracy of the information provided.

We may cancel an order where we reasonably believe that the person placing it does not have the required legal capacity or authorisation.

4. Customer Accounts

You may be permitted to create an account to manage orders, addresses and preferences.

When creating or using an account, you agree to:

  • Provide accurate, current and complete information.
  • Keep your information updated.
  • Protect your password and account credentials.
  • Prevent unauthorised access to your account.
  • Notify us promptly if you believe your account has been compromised.

You are responsible for activities carried out through your account unless the activity resulted from a security failure attributable to Five Riyal.

You may not sell, transfer, assign or provide your account to another person.

We may suspend or restrict an account where there is reasonable evidence of fraud, unauthorised access, misuse or a material violation of these Terms.

5. Product Information

We take reasonable steps to ensure that product descriptions, specifications, prices, photographs and availability information are accurate and not misleading.

Product photographs are provided for identification and illustration. Minor differences may occur due to:

  • Screen or device settings.
  • Lighting used in photography.
  • Packaging updates made by the manufacturer.
  • Manufacturing batches.
  • Minor differences that do not materially change the product.

Such differences do not permit us to supply a product that is materially different from its description, specifications or advertised characteristics.

Customers should review:

  • Product descriptions.
  • Dimensions and quantities.
  • Ingredients and allergen information, where applicable.
  • Safety warnings.
  • Usage instructions.
  • Age recommendations.
  • Warranty information.
  • Any product-specific restrictions.

Where the use of a product involves a reasonably foreseeable risk, the relevant warnings and instructions will be displayed on the product, packaging or product page as applicable.

We may update a product description or discontinue a product at any time, provided that such changes do not affect an order already accepted unless required by law or agreed with the customer.

6. Product Availability and Purchase Limits

Products are subject to availability.

Placing a product in the shopping cart does not reserve it or guarantee its availability.

We may impose reasonable quantity limits where necessary to:

  • Maintain fair availability.
  • Prevent fraud or abuse.
  • Manage limited stock.
  • Prevent unauthorised resale.
  • Comply with legal or regulatory requirements.

The website is primarily intended for ordinary retail purchases. Customers seeking wholesale quantities or purchasing for commercial resale may be required to contact us separately.

7. Placing an Order

Before submitting an order, you will be given an opportunity to review and correct the products, quantities, delivery information and payment details entered.

By submitting an order, you confirm that:

  • The information provided is accurate and complete.
  • You are authorised to use the selected payment method.
  • You have reviewed the product description and price.
  • You have reviewed the applicable delivery charges.
  • You agree to these Terms and the related policies.

After an order is submitted, we will send an electronic acknowledgement confirming that the order has been received.

An acknowledgement of receipt does not necessarily mean that the order has been accepted.

8. Order Acceptance

An order is accepted when Five Riyal:

  • Sends an express order-acceptance or dispatch confirmation; or
  • Delivers the order to the customer,

whichever occurs first.

Payment authorisation, payment processing or an automated order acknowledgement does not by itself guarantee acceptance.

We may refuse or cancel an order before acceptance where reasonably necessary, including where:

  • The product is unavailable.
  • The requested quantity is unavailable.
  • The payment cannot be authorised or verified.
  • The customer’s information is materially incorrect or incomplete.
  • There is reasonable evidence of fraud or misuse.
  • A clear and obvious pricing or product-information error occurred.
  • Delivery cannot be made to the requested location.
  • The order violates applicable law or these Terms.

Where an order is cancelled after payment has been collected, the amount paid for the cancelled products will be refunded through the original payment method or another method agreed with the customer.

9. Prices and Currency

All prices displayed on the website are stated in Qatari Riyals (QAR) unless expressly stated otherwise.

The product price applicable to an order will be the price displayed when the customer submits the order, subject to the provisions concerning clear and obvious errors.

Before the order is submitted, the checkout page will display:

  • The product price.
  • The quantity.
  • Any applicable discount.
  • Delivery charges.
  • Any other applicable charge.
  • The total order amount.

Customers will not be charged an undisclosed mandatory amount after submitting an order.

Prices offered through the website may differ from prices offered at physical stores, marketplaces or other sales channels where different promotions or operating costs apply.

10. Pricing and Information Errors

We may correct typographical, technical or administrative errors relating to:

  • Prices.
  • Product descriptions.
  • Discounts.
  • Availability.
  • Delivery charges.
  • Promotional information.

Where a clear and obvious error is identified before an order is accepted, we may:

  • Notify the customer and offer the product at the correct price or on the correct terms; or
  • Cancel the affected item and refund any payment collected.

We will not rely on this section to avoid honouring a reasonably displayed price merely because the price later becomes commercially inconvenient.

Where the error is not obvious or the order has already been completed, the matter will be handled in accordance with applicable consumer-protection law.

11. Promotions and Discount Codes

Promotions, discount codes, bundles and special offers may be subject to additional terms displayed with the relevant promotion.

Unless otherwise stated:

  • Promotions apply only during the stated period.
  • Discount codes may not be exchanged for cash.
  • Only one promotional code may be used per order.
  • Promotions may not be combined.
  • Promotions are subject to product availability.
  • Minimum-spend or product restrictions may apply.
  • Promotional benefits obtained through fraud or technical misuse may be cancelled.

Where promotional terms conflict with these Terms, the specific promotional terms will apply to the promotion, provided they do not limit mandatory consumer rights.

12. Payment

Available payment methods will be displayed during checkout and may include:

  • Credit or debit card.
  • Approved electronic payment methods.
  • Cash on delivery.
  • Other methods introduced by Five Riyal.

Payment services may be provided by third-party payment gateways, banks or financial institutions.

Five Riyal does not intentionally store full payment-card security codes. Payment information may be processed directly by the relevant payment provider.

You confirm that you are authorised to use the payment method selected.

We may conduct reasonable verification checks before accepting or delivering an order.

Cash on Delivery

Where cash on delivery is available:

  • The customer must pay the amount shown in the order confirmation.
  • The customer should prepare the correct amount where possible.
  • Availability may depend on the delivery location, order value and customer order history.
  • Repeated unjustified refusal of confirmed cash-on-delivery orders may result in restricting this payment option for future orders.

Such restrictions do not affect mandatory consumer rights.

13. Invoices and Order Records

Five Riyal will provide an invoice, receipt or accessible electronic order record showing the relevant transaction information, including the product type, quantity and price.

Invoices and legally required consumer information will be provided in Arabic or bilingually where required by applicable law.

Customers should retain the order confirmation, invoice or receipt as proof of purchase.

14. Order Cancellation and Electronic Contract Rights

Customers should contact us promptly if they wish to cancel an order.

An order may ordinarily be cancelled without charge before it has been prepared, dispatched or handed to the delivery provider.

Where preparation or dispatch has already begun, cancellation will be handled under the Return, Exchange and Refund Policy and applicable law.

Where applicable under the Electronic Transactions and Commerce Law of the State of Qatar, a consumer may have the right to rescind or terminate an electronic contract within three days from the date of entering into the contract, provided that:

  • The contract has not been fully performed in a manner that achieves its purpose.
  • The consumer has not used the product.
  • The consumer has not received a benefit or value from the product.
  • No applicable legal exception or valid agreement provides otherwise.

Five Riyal also offers the voluntary change-of-mind return rights stated in its Return, Exchange and Refund Policy.

15. Shipping and Delivery

Five Riyal currently delivers to eligible locations within the State of Qatar, subject to the Shipping and Delivery Policy.

Delivery times displayed on the website are estimates unless Five Riyal expressly confirms a guaranteed delivery time.

We will take reasonable steps to deliver orders within the stated or agreed period.

Delivery may be affected by circumstances such as:

  • Incorrect or incomplete delivery information.
  • Inability to contact the customer.
  • Severe weather.
  • Road closures.
  • Public emergencies.
  • High seasonal demand.
  • Events beyond our reasonable control.

Five Riyal will not automatically be exempt from responsibility merely because a third-party delivery provider is used.

Where delivery is materially delayed, the customer will retain all cancellation, refund and other rights available under applicable Qatari law.

Unless otherwise agreed, where delivery or contractual performance is delayed for more than the period provided by applicable law, the customer may terminate the affected contract and receive a refund of payments made for the affected products.

16. Delivery and Transfer of Risk

The risk of loss or damage remains with Five Riyal until the order is delivered to:

  • The customer.
  • A person authorised by the customer.
  • The delivery location or recipient expressly specified by the customer.

Risk does not pass to the customer merely because the order has been handed to a delivery company selected by Five Riyal.

After confirmed delivery, the customer is responsible for the reasonable care and storage of the products.

17. Customer Delivery Responsibilities

The customer must provide:

  • A complete and accurate delivery address.
  • A valid telephone number.
  • Clear delivery instructions where required.
  • Reasonable access to the delivery location.

Where delivery fails because the customer provided incorrect information, could not be contacted, was unavailable after reasonable attempts or refused a correctly supplied order, we may charge a reasonable redelivery fee where this was clearly communicated.

This does not apply where delivery was refused because the order or package was visibly damaged, incorrect, unsafe or materially non-conforming.

18. Inspection of Orders

Customers are encouraged to inspect the order promptly after delivery.

Where a product is:

  • Damaged.
  • Defective.
  • Expired.
  • Unsafe.
  • Incorrect.
  • Incomplete.
  • Materially different from its description.
  • Not compliant with applicable specifications,

the customer should contact Five Riyal as soon as reasonably possible.

Any requested early-notification period is intended to help investigate delivery issues and does not remove or reduce mandatory consumer rights.

19. Returns, Exchanges, Refunds and Defective Products

Returns, exchanges and refunds are governed by our Return, Exchange and Refund Policy.

Where a product is defective or does not conform to the applicable specifications, Five Riyal will provide the remedy required by Qatari law, which may include:

  • Refunding the amount paid.
  • Replacing the product.
  • Repairing the defect without charge, where appropriate.
  • Recalling or collecting the product.
  • Providing another remedy required by law.

The customer will not be required to pay return, collection or replacement-delivery costs for a confirmed defective, damaged, unsafe, incorrect or non-conforming product.

Nothing in these Terms requires the customer to accept store credit, loyalty points or a gift card instead of a monetary refund where the customer is legally entitled to a refund.

20. Unordered or Incorrectly Delivered Products

A customer is not required to pay for a product that was not ordered.

The customer will not be charged the cost of returning or collecting a product delivered by Five Riyal by mistake.

Customers should notify us so that the product can be collected or the correct product supplied.

21. Product Warranties

Some products may include a manufacturer, supplier or authorised-agent warranty.

Where a warranty applies:

  • The applicable warranty period and conditions will be stated on the product page, packaging, invoice or warranty document.
  • The customer may be required to provide proof of purchase.
  • Warranty claims may be inspected by the manufacturer, supplier or authorised service centre.
  • Warranty exclusions will not apply where they conflict with mandatory Qatari law.

A manufacturer’s warranty is additional to, and does not replace, the customer’s mandatory rights against Five Riyal as the supplier.

Warranty coverage may not apply to damage caused by misuse, unauthorised modification, improper installation, accident or failure to follow instructions, unless the reported issue was caused by an original defect or other matter for which Five Riyal remains legally responsible.

22. Product Safety and Recalls

Where we become aware that a product may present a material health or safety risk, Five Riyal may:

  • Suspend sales.
  • Contact affected customers.
  • Publish an appropriate safety notice.
  • Arrange collection or recall.
  • Notify the competent authorities where required.
  • Provide an appropriate refund, replacement or other remedy.

Customers should follow any safety, recall or return instructions promptly.

23. Intellectual Property

The website and its original content, including Five Riyal’s:

  • Trade name.
  • Logo.
  • Branding.
  • Website design.
  • Original text.
  • Graphics.
  • Photographs.
  • Videos.
  • Promotional materials.
  • Software and website elements,

are owned by or licensed to Five Riyal and are protected by applicable intellectual-property laws in Qatar and relevant international agreements.

You may use the website for lawful personal shopping purposes.

Without prior written approval, you may not:

  • Reproduce or republish substantial website content.
  • Use Five Riyal’s name, logo or branding commercially.
  • Modify or create derivative works from protected materials.
  • Scrape or systematically extract website content.
  • Sell, license or commercially exploit website materials.
  • Misrepresent an association with or endorsement by Five Riyal.

Rights belonging to manufacturers, Shopify or other third parties remain the property of their respective owners.

24. Customer Reviews and Submitted Content

Where the Services allow customers to submit reviews, photographs, comments or other content, the customer confirms that:

  • The content is truthful and based on a genuine experience.
  • The customer owns the content or has permission to submit it.
  • The content does not infringe intellectual-property, privacy or other rights.
  • The content is not unlawful, threatening, abusive, obscene or misleading.
  • The content does not contain malicious software or advertising spam.

By submitting content for publication, the customer grants Five Riyal a non-exclusive, royalty-free licence to display, reproduce and use that content for operating and promoting the Services.

This licence does not transfer ownership of the customer’s content to Five Riyal.

We may moderate or remove content that violates these Terms, applicable law or the rights of another person.

Personal data contained in customer submissions will be handled in accordance with our Privacy Policy.

25. Acceptable Use

You may use the Services only for lawful purposes.

You must not:

  • Use the Services to commit fraud or another unlawful act.
  • Provide false or misleading account, payment or delivery information.
  • Impersonate another person.
  • Infringe Five Riyal’s or another party’s intellectual-property rights.
  • Upload viruses or malicious code.
  • Interfere with website security or operation.
  • Attempt to gain unauthorised access to accounts, systems or data.
  • Collect another person’s personal information without authorisation.
  • Use automated tools to scrape, overload or disrupt the website.
  • Circumvent purchasing limits or security controls.
  • Use the website to send spam or unauthorised advertising.
  • Submit abusive, threatening or defamatory communications.

We may take reasonable technical or legal steps to prevent prohibited use.

26. Suspension and Termination

We may suspend or terminate access to an account where reasonably necessary because of:

  • Fraud or suspected fraud.
  • A material breach of these Terms.
  • Security risks.
  • Unlawful use.
  • Abuse of employees, delivery staff or other customers.
  • Repeated misuse of promotional, refund or payment systems.

Where reasonably possible, the customer will be informed of the reason for the restriction.

Termination does not affect:

  • Orders already accepted, unless cancellation is legally justified.
  • Amounts already due.
  • Existing consumer rights.
  • Provisions intended to continue after termination.

27. Third-Party Services and Links

The Services may include links to or integrations with independent third parties, including:

  • Payment providers.
  • Delivery providers.
  • Maps.
  • Social media platforms.
  • Communication services.
  • Analytics providers.

Five Riyal is responsible for selecting and managing its service providers as required by applicable law but does not control independent third-party websites or their content.

Customers should review the applicable terms and privacy notices before using an independent third-party service.

The inclusion of a link does not necessarily mean that Five Riyal endorses all content or services provided by that third party.

28. Relationship With Shopify

The Five Riyal online store is powered by Shopify.

Shopify provides the technology used to host and operate the store but is not the seller of the products purchased from Five Riyal.

The contract of sale is between the customer and Five Riyal Trading W.L.L.

Five Riyal remains responsible for:

  • Products offered for sale.
  • Product descriptions and prices.
  • Accepting and fulfilling orders.
  • Delivery arrangements.
  • Customer service.
  • Returns and refunds.
  • Compliance with applicable Qatari laws.

Shopify’s processing of personal data is addressed in our Privacy Policy and Shopify’s applicable privacy documentation.

29. Privacy

Personal data collected through the Services is processed in accordance with our Privacy Policy and applicable data-protection laws.

By using the Services, you acknowledge that certain data may be processed by Shopify, payment providers, delivery providers and other authorised service providers where necessary to operate the Services and fulfil orders.

Consent to these Terms does not constitute consent to receive marketing communications. Marketing communications will be sent only in accordance with applicable consent requirements.

30. Website Availability

We take reasonable steps to maintain the availability and security of the Services.

However, the website may occasionally be unavailable because of:

  • Maintenance.
  • Technical failures.
  • Security incidents.
  • Internet or hosting interruptions.
  • Events outside our reasonable control.

We do not guarantee that every website function will be uninterrupted or error-free at all times.

This section does not limit liability for a failure to exercise reasonable care or comply with mandatory legal obligations.

31. Limitation of Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from:

  • Fraud or intentional misconduct.
  • Gross negligence where applicable.
  • Death or personal injury caused by a legally attributable act or omission.
  • Defective or unsafe products.
  • Violation of mandatory consumer rights.
  • Violation of applicable data-protection obligations.
  • Any other liability that cannot be excluded under Qatari law.

Subject to the above and to the fullest extent permitted by applicable law, Five Riyal will not be liable for indirect or consequential commercial losses that were not reasonably foreseeable and did not result from our breach of a legal or contractual obligation.

Nothing in this section relieves Five Riyal of an obligation imposed by the Consumer Protection Law or other applicable legislation.

32. Force Majeure and Events Outside Our Control

Five Riyal will not be responsible for a delay or failure caused by an event outside its reasonable control, including:

  • Natural disasters.
  • Severe weather.
  • Epidemics or public-health emergencies.
  • War or civil disturbance.
  • Government restrictions.
  • Widespread telecommunications or electricity failures.
  • Road closures.
  • Labour disruptions not limited to Five Riyal’s own workforce.

We will take reasonable steps to minimise the effect of the event and inform affected customers where appropriate.

Where performance becomes impossible or is materially delayed, customers will retain any cancellation or refund rights provided by applicable law.

33. Complaints

The complaint should include:

  • The customer’s name and contact information.

Nothing in these Terms prevents the customer from submitting a complaint to the competent Consumer Protection authority or pursuing another remedy available under Qatari law.

34. Changes to These Terms

We may update these Terms to reflect changes in:

  • Applicable laws or regulations.
  • Our business operations.
  • Our Services.
  • Payment or delivery arrangements.
  • Security requirements.

The updated version will be published on the website with a revised “Last Updated” date.

Material changes will apply prospectively unless applicable law requires otherwise.

The terms governing an order will generally be the version available when the order was submitted, unless a subsequent change is required by law or provides the customer with greater protection.

35. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.

The remaining provisions will continue in effect.

36. No Waiver

Failure by Five Riyal to enforce a provision on one occasion does not constitute a permanent waiver of that provision or another right.

Any waiver must be express and applies only to the specific circumstances for which it was given.

37. Assignment

The customer may not transfer contractual rights or obligations relating to an order without our prior written approval, except where applicable law permits otherwise.

Five Riyal may transfer its rights and obligations as part of a lawful merger, restructuring or transfer of business, provided that the transfer does not reduce the customer’s mandatory rights.

38. Entire Agreement

These Terms and the policies incorporated by reference constitute the agreement between Five Riyal and the customer concerning use of the Services and purchases made through the website.

Nothing in this section excludes:

  • An express product warranty.
  • A written commitment made by Five Riyal.
  • A mandatory legal right.
  • Liability arising from a false or misleading representation.

39. Governing Law and Jurisdiction

These Terms, the use of the Services and purchases made through the website are governed by the applicable laws and regulations of the State of Qatar.

Any dispute shall be subject to the jurisdiction of the competent courts of the State of Qatar, without limiting the customer’s right to submit a complaint to a competent consumer-protection or regulatory authority.

40. Language

These Terms may be published in Arabic and English.

If there is a conflict between the Arabic and English versions, the Arabic version shall prevail to the extent permitted or required by the laws of the State of Qatar.

Both versions should be interpreted in a manner that preserves mandatory consumer rights.
